  • Descrição: The Labor Court from the state of Rio Grande do Sul recognized the worker right from a nightclub to the unhealthy work bonus in the maximum degree due to the secondhand workplace exposure. This decision is to repair the damage caused to the worker: the secondhand smoke exposure. However, according to the Brazilian Constitution, all employer/contracting party has the duty to promote smoke-free workplaces. There is no option to pay the unhealthy work bonus during an existing labor contract. In case of effective damage to the worker's health, he/she is able to make a claim before the Court in order to claim compensation. Adapted from the source document.
