  • Descrição: This article's scope is to perform an observation of the contemporary systemic theories proposed by Niklas Luhmann and Gunther Teubner. In the light of such perspectives, the Law can be seen as an autopoietic social subsystem, which is reproduced from itself, setting your own limits of meaning. While Luhmann forges the epistemological foundations of a legal and social autopoietic theory, Teubner goes further, stating that legal autopoiesis is possible only when the circular author-referential relationships of the legal system components are made in a way that allows their own articulation and interconnection in a self-reproductive hypercycle. It is understood that both systemic perspectives can be viewed as complementary. The methodology used in this research was the constructivist-systemic approach developed by the Theory of Social Systems (Luhmann). The technical/research method used for this approach was the bibliographic. Indeed, such systemic observations offer a viable alternative to the problem of the closing/opening of the legal system starting from the concept of autopoiesis.
