  • Descrição: O presente trabalho tem por objetivo resgatar a participação das professoras Lélia Gonzalez e Helena Theodoro na Assembleia Nacional Constituinte de 1987-88 (ANC) e propor um constitucionalismo pautado na categoria político-cultural de amefricanidade para investigar o lugar de negro na história constitucional brasileira do pós-abolição. Pois, consideramos que a participação das duas intelectuais e militantes negras é crucial para compreendermos a Educação das Relações Étnico-raciais na atualidade. Além disso, é importante ressaltar que a Educação das Relações Étnico-raciais está prevista nas DCN's para os cursos de graduação em Direito de 2018. A pesquisa foi realizada através da análise das atas da Subcomissão dos Negros, Populações Indígenas Pessoas Deficientes e Minorias da ANC. Dessa forma, defendemos junto com a professora Thula Pires um direito de tipo nosso. Por isto, propusemos neste trabalho um constitucionalismo amefricano. Dessa forma, o buscamos propor outra abordagem para o constitucionalismo a fim de que se possa analisar os direitos da população negra desde uma perspectiva afrocentrada e pautada nas contribuições teóricas elaboradas pelo movimento negro, pelo pensamento pós-colonial, pelo pensamento feminista negro e pelo grupo Modernidade/Colonialidade. Educação das Relações Étnico-raciais The present work aims to rescue the participation of professors Lelia Gonzalez and Helena Theodoro in the National Constituent Assembly of 1987-88 (ANC) and to propose a constitutionalism based on the political-cultural category of africanity to investigate the place of black people in the Brazilian constitutional history of post-abolition. For, we consider that the participation of the two black intellectuals and activists is crucial to understand the Education of Ethnic-Racial Relations today. In addition, it is important to point out that the Education of Ethnic-Racial Relations is provided for in the DCN's for the 2018 Law degree courses. of the ANC. In this way, together with Professor Thula Pires, we defend a right of our own type. For this reason, we proposed in this work an Amefrican constitutionalism. In this way, we seek to propose another approach to constitutionalism so that the rights of the black population can be analyzed from an Afrocentric perspective and based on theoretical contributions made by the black movement, postcolonial thought, black feminist thought and the group Modernity/Coloniality Keywords: Amefricanity.
