  • Descrição: This work depicts the aqueous scenario in which public contracts are entered, highlighting aspects of efficiency, as well as the risk-sharing scheme. This investigation is justified by the need to readjust to the negotiating practice of public administration, taking into account the ambivalence, uncertainty and instability which affect the postmodern society. The dark atmosphere that involves the State contractual environment requires maximum effort of public managers and civil society, aimed at mitigating the impacts affecting the set of individual and collective rights, in order to ensure the dignity of the human person in contemporary social context and prospective. This requires a continuous process of improvement of methods, requiring flexibility too prescriptive rigidity for the regulation of administrative agreements, especially with regard to major projects. In addition to identifying the incongruities of the scheme of distribution of decorative, enshrined by law 8,666/93, this article aims to reveal a systematic risk distribution founded on ideals of sustainability and good governance. To achieve this purpose was employed the dialectical methodology descriptive, starting from a dialogue between authors of science and law experts in modeling projects. As a final result of the research, was evidenced that the accommodation of the risks in accordance with the capacity of contracting parties and the efficient dynamics of public administration are prerequisites for practical applicability of the sustainability.
