  • Descrição: In its complaint, Transdev alleged, amongst other arguments, that the Société nationale des chemins de fer français (France's national State-owned railway company, hereinafter "SNCF"), abused its dominant position in the rail passenger transport market by allowing its wholly owned subsidiary Ouibus, one of Transdev's competitors in the emerging passenger transport by coach market, to benefit from cross-subsidies between its monopoly activities in the rail sector and its competitive activities in the intercity transport of passengers in the coach sector.According to French regulations, whenever a developer purchasing land with the intention of developing and selling building plots could destroy or damage a site that may contain archaeological remains, the French State may require that rescue excavations be carried out.Additionally, as a public institution having both an administrative role and public service missions, INRAP is largely financed by public funds.Because of the lack of separation between such activities and INRAP's competitive activities, there is a risk of potentially anticompetitive crosssubsidies.
