  • Descrição: The 21st century is marked by the consolidation of the 4th Industrial Revolution that is justified by the unequivocal physical-biological-digital interaction, without the possibility to divide them. Under this perspective the research is developed, aiming to establish an ethicallegal-social analysis about the real influence that artificial intelligence (AI) has in the jurisdictional provision, being certain that humanity goes through a profound transformation phase in all sectors. Thus, thinking about how AI can assist in the 'justice crisis' in Brazil, since the judicial system debureaucratization has deserved closer attention and major investments. It is possible to glimpse that part of the aforementioned obstacles, such as extreme bureaucracy, the delay in the processes operation and in the continuous judgments in inequality can be resolved through artificial intelligence, which has already been a reality in Brazil and in the world. The great challenge, however, is to establish criteria that can combine new technologies with pre-existing human skills, without violating the fundamental rights and personality of the jurisdiction, including all actors participating in the procedural field, such as lawyers, judges, civil official and others. Through the hypothetical-deductive method, the study aims to present the state of the art effects of the artificial intelligence technologies use, which are already a reality within the Brazilian Judiciary System. Therefore, an analyses will be conducted on how the AI tools can be used to access to justice, from the perspective of the fundamental rights of freedom, in order to guarantee the individuals personality rights. O seculo XXI e marcado pela consolidacao da 4a Revolucao Industrial que se justifica pela inequivoca interacao fisica-biologica-digital, sem que seja possivel dividi-las. Sob esta perspectiva e que se desenvolve esta pesquisa, objetivando estabelecer uma analise etica-juridicasocial acerca da influencia real que a inteligencia artificial (IA) exerce na prestacao jurisdicional, sendo certo que a humanidade passa por uma fase de profunda transformacao em todos os setores. Assim, pensar em como a IA pode auxiliar na 'crise da justica' no Brasil, uma vez que a desburocratizacao do sistema judicial tem merecido atencao mais proxima e grandes investimentos. E possivel vislumbrar que parte dos aludidos entraves, como a burocracia extrema, a demora na tramitacao dos processos e nos continuados julgamentos em desigualdade podem ser resolvidos por intermedio da inteligencia artificial, o que ja tem sido uma realidade no Brasil e no mundo. O grande desafio, entretanto, e estabelecer criterios que possam aglutinar as novas tecnologias com as habilidades humanas pre-existentes, sem violar os direitos fundamentais e da personalidade do jurisdicionado, incluindo todos os atores participantes da seara processual, como advogados, magistrados, servidores e outros. Por meio do metodo hipotetico-dedutivo, essencialmente doutrinario, o estudo objetiva apresentar o estado da arte, em revisao bibliografica, acerca dos efeitos que o uso das tecnologias da inteligencia artificial, que ja sao realidade junto ao Poder Judiciario Brasileiro. Assim, analisar-se-a como as ferramentas de IA podem concretizar o acesso a justica, a partir de uma perspectiva dos direitos fundamentais da liberdade, de modo a garantir os direitos da personalidade dos individuos.
