  • Descrição: Examines recent developments in civil procedure, covering the following topics: representative actions and their relationship to the use of class actions in other jurisdictions; the Court’s jurisdiction to strike out proceedings on the grounds of abuse of process; issue estoppel, with reference to such cases as ‘McGougan v DePuy International Ltd’; and, applications for security for costs, with reference to ‘Heke (also known as Lewis Reginald Stanton) v Nelson City Council’. Also looks at the effect of the Senior Courts (Access to Court Documents) Rules 2017 on the granting of access to court documents, together with increasing use of electronic casebooks in the senior courts and the trend towards increasing digitisation of the litigation process, particularly in light of the effects of the COVID-19 pandemic.
