This article discusses the way in which Maimonides constructed a theory of halakha from the unsystematic discussions in the Talmud. Maimonides'
architecture
of the Law was influenced by philosophical assumptions that were presented in his Guide of the Perplexed. According to Maimonides, there is a core of commandments and rules which are directly attributed to Moses. Only this indisputable core has the legal status of de-oraita. Having established the concept of the core, Maimonides introduces a unique theory of interpretation, in which he claims that the rules learned by interpreting the core do not have the status of the core, but rather the legal status of derabanan. The claim that Midrashic interpretation does not have the status of de-oraita is problematic in light of Talmudic material. Naḥmanides takes issue with this question and develops an alternative approach to legal interpretation of halakha. This article analyses the conflict between these two conceptions of legal interpretation.
