  • Descrição: This paper analyzes the expressiveness of the President of the Brazilian Republic during the pandemic caused by the new coronavirus and his possible confrontation with the specific constitutional duties related to the public health. Would the President's freedom of speech so extensive to allow him to encourage the use of drugs without proven efficacy and openly criticize quarantine and social distancing measures? Such research problem initially calls for an understanding of the institute of special subjection relations, mainly the specific duties that may reach public agents, limiting the exercise of fundamental rights, including freedom of speech. Then we investigate some of the most relevant speeches during the pandemic, identifying the respective dates, contents and communicative supports. We proceed to the study of the constitutional duties of the President that may clash with the aforementioned discourses: duty to safeguard and promote public health; duty of respect to the Constitution; and duty to provide information of social relevance with accuracy, clarity and suitability. To solve the collision, we use the balancing principle method, which led to the conclusion: the statements and the actions of the President overflowed the protective limits of freedom of speech and violated the Constitution. Finally, we analyze the possibility configuration of the president responsibility for crimes and personal responsibility, provided for in article 85, III, of the Brazilian Constitution. The methodology is predominantly qualitative, but also covers the case study in the section dedicated to the examination of presidential pronouncements. The research is exploratory and applied. O artigo analisa a expressividade do Presidente da Republica durante a pandemia causada pelo novo coronavirus e o seu possivel confronto com os deveres constitucionais especificos relacionados a saude publica. Questiona-se: seria a liberdade de expressao do mandatario tao extensa ao ponto de lhe permitir incentivar o uso de medicamentos sem eficacia comprovada e criticar abertamente as medidas de quarentena, distanciamento e isolamento social? Tal indagacao reclama, inicialmente, a compreensao do instituto das relacoes especiais de sujeicao, mormente dos deveres especificos que podem recair sobre os agentes publicos, limitando o exercicio de direitos fundamentais, dentre os quais a liberdade de expressao. Sao examinados, em seguida, alguns dos pronunciamentos mais relevantes emitidos ao longo da pandemia, identificando-se as respectivas datas, conteudos e suportes comunicativos. Procede-se ao estudo dos deveres constitucionais do Presidente da Republica que podem colidir com as referidas modalidades expressivas: dever de resguardar e promover a saude publica; dever de fidelidade a Constituicao; e dever de prestar informacoes de relevancia social com veracidade, clareza e idoneidade. Para resolver colisao, e empregada a tecnica da ponderacao de principios, ao cabo da qual e obtida a conclusao: as declaracoes e acoes do Presidente desbordaram dos limites protetivos da liberdade de expressao e violaram a Constituicao. Por fim, analisa-se a possibilidade de configuracao do crime de responsabilidade previsto no artigo 85, III, da Constituicao de 1988. A metodologia e predominantemente qualitativa, mas abrange tambem o estudo de caso na secao dedicada ao exame dos pronunciamentos presidenciais. A pesquisa e exploratoria e aplicada.
